DISTANCE SALES CONTRACT  


Article 1 - Parties to the Contract

Article 2 - Subject of the Contract  

2.1. The Buyer acknowledges and declares that they have been informed about the essential characteristics, sales price, payment method, delivery conditions, and all preliminary information regarding the goods/services subject to sale, including the right of withdrawal, and that they have confirmed this information electronically and placed an order in accordance with the terms of this contract. Furthermore, the individual named on the invoice is a party to this contract and is responsible for providing accurate and complete information. The Buyer preemptively accepts liability for any damages or issues arising from incorrect or incomplete information.  


2.2. The pre-information and invoice provided on the payment page of the website www.vicunafur.com form an integral part of this contract.  



Article 3 - Date of the Contract and Force Majeure  


3.1. This two-copy contract, previously signed by the Seller, is signed by the Buyer on ............. and will be sent to the Buyer via email.  


Unforeseeable and unavoidable events beyond the control of the parties, which prevent or delay the fulfillment of the obligations of the contract by either or both parties, will be considered force majeure. The party experiencing the force majeure must notify the other party in writing immediately.  


3.2. Force majeure includes but is not limited to natural disasters, war, terrorism, riots, changes in legislation, seizures, strikes, lockouts, and significant disruptions in production or communication facilities. Neither party will be held liable for their inability to perform their obligations due to force majeure. If the force majeure persists for 30 (thirty) days, either party has the right to unilaterally terminate the contract.  



Article 4 - Delivery Costs and Execution  


4.1. Delivery costs are borne by the Buyer. However, if the Seller has declared on the website that delivery costs will be covered for purchases above a certain amount, the delivery cost will be borne by the Seller.  


4.2. Delivery will be made as soon as possible, subject to stock availability and after the payment is transferred to the Seller’s account. The Seller delivers the goods/services within 30 (thirty) days of the order and reserves the right to extend this period by an additional 10 (ten) days with prior written notice. If, for any reason, the payment is not made or canceled in the bank records, the Seller is deemed free from the obligation to deliver the goods/services.  



Article 5 - Rights and Obligations of the Seller  


5.1. The Seller is responsible for delivering the goods/services subject to the contract in a sound, complete, and proper manner as specified in the order, along with warranty documents and user manuals, if applicable.  


If the goods/services are to be delivered to a person/organization other than the Buyer, the Seller cannot be held responsible if the person/organization refuses the delivery.  


Upon receipt of the withdrawal notice, the Seller will refund the goods/services within 14 (fourteen) days and refund the payment within 10 (ten) days after receiving the returned product. The Seller may provide goods/services of equal quality and price before the contract period expires if there are justified reasons.  


5.2. If it is impossible for the Seller to fulfill their obligations under this contract, they will notify the Buyer before the end of the performance period. The paid amount and any associated documents will be returned within 10 (ten) days. Goods/services sold with or without a warranty may be sent to the Seller for necessary repairs within the warranty terms, with delivery costs borne by the Buyer.  


5.3. The Buyer must be over 18 years old. The Seller will rely on the age information provided by the Buyer in the contract. If incorrect information is provided, the Seller cannot be held responsible. If payment is not made within 3 (three) days of the order date, the Seller may unilaterally cancel the sale.  



Article 6 - Rights and Obligations of the Buyer  


6.1. The Buyer agrees to fulfill their obligations under this contract, except in cases of force majeure. They also accept all terms of this contract by placing an order.  


6.2. The Buyer will inspect the goods/services before accepting them from the courier. They must not accept goods/services that are damaged, crushed, broken, or with torn packaging. Goods/services accepted from the courier are deemed to be in good condition. The responsibility for protecting the goods/services after delivery lies with the Buyer. The invoice on the courier package should be kept for returns.  


6.3. If the payment made by the Buyer’s credit card is reversed by unauthorized persons for reasons beyond the Buyer’s fault, the Buyer must return the delivered goods/services to the Seller within 3 (three) days. Delivery costs in this case are borne by the Buyer.  


6.4. The Buyer acknowledges having read and understood all the information on the www.vicunafur.com website regarding the Seller, the goods/services, the right of withdrawal, and all related procedures.
